SITG 2022 VOLUNTEER APPLICATION TERMS & CONDITIONS GENERAL INFORMATION • Splendour in the Grass Pty Ltd (ABN 93 096 535 616) (SITG) is the promoter of the Splendour In The Grass 2022 music festival (Festival). • The Festival is located at North Byron Parklands, 126 Tweed Valley Way, Yelgun NSW 2483 and will take place between 22 and 25 July 2022 (inclusive) (Festival Dates). • These terms and conditions apply to all volunteers engaged by SITG to perform volunteer duties at the Festival (Volunteers). The relationship between SITG and the Volunteers is not an employment relationship or a relationship of principal and contractor. • The Festival is a licensed event and all Volunteers must be over 18 years of age before they begin their Volunteer duties. • Volunteers must provide current and valid photo ID as part of their application process. VOLUNTEER DUTIES • Volunteers may be engaged to perform duties from the Tuesday before, to the Monday after the Festival Dates (Festival Event Volunteers) or prior to the Festival Dates (Pre-Festival Volunteers). Volunteers will be required to perform duties in a variety of areas and capacities to meet the reasonable demands of the Festival. • Please note, for Splendour in the Grass 2022, Festival Event Volunteers must be available to be on site for the whole period of 19 to 25 July. • Festival Event Volunteers are expected to volunteer between 18-22 hours (as advised and directed by SITG) during the Festival Dates. • Pre-Festival Volunteers are expected to volunteer two full days from 7.30am to 5pm during the period 30 days prior to the Festival Dates. • All Festival Event Volunteers will receive: a) free access to the Festival; b) access to the Festival camping area and facilities in accordance with your level of accreditation; c) access to offsite car parking; c) 1 x volunteer t-shirt; d) provision of water and sunscreen during volunteer hours. • All Pre-Festival Volunteers will receive: a) free access to the Festival; d) provision of water and sunscreen during volunteer hours. CONTACT PERSON • Volunteers are expected to follow the reasonable directions given to them by of any member of SITG’s management team, including the Volunteer Coordinator or Volunteer Team Leader. SHIFT SIGN-ON & OFF • Volunteers must sign in and out of their rostered shifts each day. • Pre-Festival Volunteers must sign in and out with the Volunteer Coordinator, who will be located opposite the WH&S shed in the parking area. • Festival Event Volunteers must sign-in and out at HQ with a Volunteer Team Leader. • If SITG cancels the Festival for any reason whatsoever at any stage: a) Pre-Festival Volunteers who have fully completed their volunteer duties will receive a ticket to the Festival for the following year; b) Festival Volunteers who have not fully completed their volunteer duties will not be entitled to a ticket to the Festival for the following year. • For the avoidance of doubt and notwithstanding the foregoing, if the Festival is cancelled for whatever reason, Volunteers will not be entitled to any payment, entitlement or compensation other than as described in these terms and conditions. POLICIES AND PROCEDURES • In addition to these terms and conditions, Volunteers are required to comply with all other SITG policies and procedures as amended from time to time including, without limitation, the terms and conditions of entry on the Festival event ticket and camping ticket. • Volunteers acknowledge that SITG’s policies and procedures do not form part of these terms and conditions or create any right or entitlement for the Volunteers. HEALTH AND SAFETY INDUCTION • SITG is serious about its Volunteers’ safety. Volunteers must read and understand the Festival’s and SITG’s WH&S policies and procedures and follow all reasonable instructions of accredited staff. • Volunteers must act at all times with the utmost regard to their safety and the safety of all other persons at the Festival site. • All Volunteers must complete WH&S induction prior to arriving at the Festival. • Volunteers acknowledge that at all times they are performing their volunteer duties they are representatives of SITG and the Festival and their behaviour with regards to health, safety and security must reflect a professional and safe environment. • SITG will not be responsible or liable for any damage to or loss of Volunteers’ property or possessions or injury to Volunteers during the course of their engagement, unless directly caused by SITG’s gross negligence. Volunteers agree to enter the Festival site at their own risk and will be solely responsible for their own property and possessions. STANDARDS OF BEHAVIOUR • Volunteers must behave in a responsible, honest, friendly and helpful manner at all times. • SITG will not tolerate: discrimination or harassment of Festival patrons or performers or SITG personnel; rude, threatening or antisocial behaviour; wilful disobedience; serious misconduct; fraud; attempted fraud; theft; attempted theft; dishonesty; wilful or reckless damage to SITG’s property; wilful or reckless injury to another person; wilful or negligent disclosure or misuse of Confidential Information; or illegal activity. • Volunteers must not be under the influence of alcohol and/or illegal drugs while performing their Volunteer duties. REMOVAL/CESSATION OF VOLUNTEER DUTIES • Volunteers who do not comply with these terms and conditions, SITG or Festival policies and procedures, directions of SITG, or engage in misconduct, may be removed their duties and the Festival without notice. • If a Volunteer is removed from their volunteer duties and/or the Festival, they must immediately deliver to SITG all property belonging to SITG (including, without limitation, Confidential Information), which is in their possession or under their control. CONFIDENTIALITY • Confidential Information: means all information provided by the Festival to a Volunteer; all information which a Volunteer becomes aware of which concerns the business and affairs of SITG, the Festival or another Volunteer or Participant. Confidential Information includes Intellectual Property. • Intellectual Property: means an invention or discovery; manner, method or process; drawing or design; computer program; copyright, including written works and photographs; trade secret, know-how, or right of secrecy or confidentiality in respect of any information or document. • Participant: means a performer, worker or Volunteer at the Festival. • Volunteers must use the Confidential Information only in the proper performance of their duties at the Festival. All documents and materials (including without limitation files, letters, data, records, whether digital or otherwise) containing Confidential Information prepared by a Volunteer or in the Volunteer’s possession are the property of SITG and the Festival. • Volunteers must protect the confidentiality of the Confidential Information and must not disclose or communicate the Confidential Information to any person, company or organisation without SITG’s prior written consent. Volunteers must immediately notify their supervisor if they believe an unauthorised person has possession of Confidential Information or has made improper or unauthorised use of the Confidential Information. • Volunteers must not copy or remove from the Festival any Confidential Information without the prior written consent of SITG. Upon request or cessation of their duties, Volunteers must promptly deliver to SITG all property of SITG, including but without limitation Confidential Information, keys, equipment, accreditation which are in the Volunteer’s possession or control. • Your confidentiality obligations to SITG will continue after the cessation of your volunteer duties. PUBLIC RELATIONS AND MEDIA • Volunteers must endeavour to protect the public image of SITG and the Festival at all times and must not give any interviews, on or off the record, without SITG’s prior consent. • Volunteers must not record, discuss or disclose anything that, in the opinion of SITG, may harm the public image of SITG, the Festival or a Participant in any way including, without limitation, filming or photographing other persons who are in an affected state. • Volunteers agree that any images, video and sound recordings taken of them while performing their volunteer duties may be used by SITG as positive promotion of the Festival. SECURITY CHECKS • Volunteers may be required to undergo a security check prior to commencement of their Volunteer duties and Volunteer bags will be checked upon entry to the Festival site. NO AUTHORITY TO ACT • Volunteers must not undertake any activity outside of their assigned Volunteer duties and acknowledge that they have no authority to bind SITG or the Festival to any contract or obligation and will not directly or indirectly assume or create any obligation on behalf of SITG or the Festival. MEDICAL HISTORY • In applying for a volunteer role, all Volunteers warrant that they do not have any medical history, pre-existing illness or injuries, which could be aggravated by undertaking their Volunteer duties. • Volunteers must wear appropriate footwear and clothing at all times at the Festival and earplugs must be worn if the Volunteer is required to perform their duties in a noisy environment. PRE-AUTHORISATION OF YOUR CREDIT CARD • Accepted Festival Event Volunteers must register a valid credit card prior to their arrival on-site. The credit card will not be charged at that time. A pre-authorisation will be held on each Volunteer’s card and their card will only be charged if they do not complete their rostered shifts. This is how SITG ensures all Volunteers complete their rostered shifts. • Any Volunteer who fails to attend or complete their rostered shifts will have the value of a full event ticket ($415.00) plus camping ($135.00) and an additional $100.00 administration fee charged to the credit card provided. • Unless otherwise agreed by SITG, any Volunteer who fails to provide at least 48 hours’ notice (from their scheduled arrival date) of cancelling their Volunteer role or is found to have breached these terms and conditions will be charged a $100 administration fee (which SITG may waive at its sole discretion). COVID • You agree to comply with all relevant government COVID-19 public health and emergency directions, or any directives specifically related to the Event, as well as the Event’s approved COVIDSafe plans. ACKNOWLEDGEMENT AND CONFIRMATION • By agreeing to perform Volunteer duties at the Festival, Volunteers acknowledge they have read, understood and accept all of the terms and conditions contained herein. • These terms and conditions are governed by and shall be construed in accordance with the laws of the State of New South Wales.
